These Terms of Service (“Terms”) govern access to and use of the Cypher marketplace operated by
Cypher TCG LLC (“Cypher,” “we,” “us”).
By accessing or using Cypher, you agree to these Terms and all referenced policies.
1. Platform Role
Cypher is an online marketplace that facilitates transactions between independent buyers and sellers.
Cypher is not the seller of items listed and does not take ownership of inventory.
2. Eligibility & Accounts
- Users must be 18 years or older
- Users must provide accurate account information
- Users may not maintain multiple accounts to evade enforcement
3. Marketplace Transactions
- Sellers list items; buyers purchase through Stripe-powered checkout
- All sales are binding once payment is completed
- Funds are held until delivery confirmation per Cypher policies
4. Fees & Payments
- Platform fees and processing fees are disclosed to sellers in their Dashboard

Cypher levies a 5.5% platform fee on the subtotal of transactions before shipping and tax are added.

Cypher lowers platform fees to 0% for transactions that occur after a seller crosses
$50,000 in revenue within a calendar month. This resets monthly and may be affected by
returns and disputes.

Stripe processes all payments and levies a processing fee of
3% + $0.03 per transaction which is borne by the Seller.
These fees may decrease over time.

Cypher may offset refunds, disputes, or penalties against seller balances
5. Prohibited Conduct
Users may not:
- List counterfeit or altered items
- Misrepresent products
- Attempt to circumvent the platform for transactions
- Abuse disputes or refund systems
- Interfere with platform integrity
6. Enforcement & Suspension
Cypher may suspend or terminate accounts at its discretion for violations, risk, or abuse.
7. Intellectual Property
Cypher owns all platform systems, databases, XP mechanics, and proprietary tools.
Users may not copy, scrape, or misuse Cypher content.
8. Disclaimers & Limitation of Liability
Cypher provides services “as is.”
Cypher is not liable for indirect or consequential damages.
9. Arbitration & Governing Law
Disputes are resolved via binding arbitration in Harris County, Texas.
Texas law governs these Terms.
